NOTWITHSTANDING ANYTHING TO THE CONTRARY IN THIS AGREEMENT, IN NO EVENT WHATSOEVER SHALL AquaVB BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL damages.

Indemnification

You agree to assume liability for and agree to indemnify, protect, release, and hold the AquaVB harmless from and against any and all liabilities, obligations, losses, damages, penalties, claims, actions, suits, costs, expenses, or disbursements (including legal fees and expenses) of any kind and nature in any way relating to or arising out of (i) this Agreement or the performance or the enforcement of any of the terms of this Agreement; or (ii) the purchase, lease, ownership, possession, use, operation, resale, or other disposition of the AquaVB Products, including without limitation, any such activities that result in bodily injury, death, or damage to property. Company agrees that the AquaVB will not be liable to you for any liability, claim, loss, damage, or expense of any nature arising in strict liability or caused directly or indirectly by the inadequacy of the Products for any purpose, any deficiency or defect, the use or maintenance of the Products, any repairs, servicing or adjustments to the Products, or any delay in providing or failure to provide any Products. You agree to release the AquaVB from any liability for, and will protect, defend, and indemnify AquaVB from and against, any and all claims, demands, and causes of action of every kind and character without limit and without regard to cause or causes of any claim, demand, or cause of action or the negligence of any party or parties, including, but not limited to, the indemnified party, arising in connection with any claim, demand, or cause of action for bodily injury, death, or damage to property.

Product Updates/Errors on Site

Product information displayed on the Site may become outdated without prior notice due to unanticipated changes brought on by the manufacturer. In an effort to serve our customers we strive to keep up to date with any revisions, however, we are not responsible for any variations in product specifications. Prices and availability of products and services are subject to change without notice. Errors will be corrected where discovered, and AquaVB reserves the right to revoke any stated offer and to correct any errors, inaccuracies or omissions including after an order has been submitted and whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, AquaVB will issue a credit to your credit card account in the amount of the charge. If you are not fully satisfied with your purchase, you may return it in accordance with AquaVB Return Policy.

General

Any cause of action you may have with respect to your use of the Site must be commenced within one (1) year after the claim or cause of action arises. If any provision of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, then such provisions shall be construed, as nearly as possible, to reflect the intentions of the invalid or unenforceable provisions, with all other provisions remaining in full force and effect. No joint venture, partnership, employment, or agency relationship exists between you and AquaVB as a result of this agreement or use of the Site. The failure of AquaVB to enforce any right or provision in this Agreement shall not constitute a waiver of such right or provision unless acknowledged and agreed to by AquaVB in writing. Neither party shall be liable to the other party for any failure to perform any of its obligations (except payment obligations) under this Agreement during any period in which such performance is delayed by circumstances beyond its reasonable control including, but not limited to, fire, flood, war, embargo, strike, riot or the intervention of any governmental authority. If you have not entered into another written agreement with AquaVB regarding the subject matter contained herein, then this Agreement comprises the entire agreement between you and AquaVB and supersedes all prior or contemporaneous negotiations, discussions or agreements, whether written or oral, between the parties regarding such subject matter. However, if you and AquaVB have entered into another written agreement regarding the subject matter set forth herein that is a written and signed agreement between you and AquaVB, then this Agreement should be read and interpreted in conjunction with such agreement and, in the event of a conflict between this Agreement and a written, signed agreement between the parties, the written, signed agreement shall govern and control.
